You agree to be bound by the following terms and conditions, (we have the right to revise these terms and conditions from time to time) when using our site or ordering a Home Information Pack and local searches.

A.L.M Data Solutions:

We reserve the right to revise or withdraw any of the services provided by us without notice.

Ordering a Home Information Pack:

A legally binding contract to supply a home information pack and local searches will be formed upon payment of the relevant fees.

Price and Payments:

The transaction from the website will be taken via PayPal.

The amounts charged for our Home Information Packs are displayed on our pricing sheet or can be communicated via email or by telephone. To make a payment for our Home Information Packs and searches you must order online.

Payments must be made in advance of any work that A.L.M Data Solutions is requested to undertake.

Delivery:

The pack is usually completed within 7 – 14 days.

UK Coverage.

Appointments:

Any missed appointment, where an agent of the company has to revisit your property, will incur an additional £20.00.

Cancellation/Refund Policy:

Once the Home Information Pack is ordered, you will be unable to cancel the Home Information Pack.

Cancellations will incur and administration fee of £50 when an Energy Assessor has not visited the property for which the Home Information Pack has been ordered. If this visit has taken place, there will be an additional cancellation charge of £70. In addition, you will be also be liable for any charges made to us for third party services required to obtain the necessary documents contained in the Home Information Pack.

We reserve the right to accept or cease an order for the compilation of a Home Information and local searches.

This does not affect your statutory rights as a consumer or under the “Home Information Pack Regulations”.

The accuracy of the information you supply to us:

The information your provide us will form part of the Home Information Pack and will be relied upon by third parties. You must ensure that all the information by you is factual; correct; accurate; complete and, valid.

Limitation of Liability:

You are advised that our compilation of the HIP is dependent upon both you and others providing information and, in compiling it will we will not visit the property. Although we will be responsible for the compilation of the HIP and for ensuring that it contains all required documents and information, we accept no responsibility for any decisions made by or any third party relying on a HIP that is correctly compiled by us.

We cannot accept any liability for an error in a report which is based on any error or inaccuracy in a public register. Nor will we be liable for any information contained within a report which is based on information that we have obtained from a third party.

We cannot accept any responsibility for any inaccuracy or error in the HIP/EPC that is based on incomplete or inaccurate information in the Order.

Force Majeure:

We will not be liable for any failure to perform the services due to an event beyond our reasonable control. If our performance of the services is delayed due to an event beyond our reasonable control, we will notify you promptly of the reason for such a delay and you agree to give us such an extension to perform the services as is reasonable in the circumstances.

Your Obligations:

You will ensure that the information you supply us in the order, including without limitation details of the property, is complete, accurate and up to date and you will notify us if you become aware of any inaccuracy contained within the order.

If there is any conflict between a provision of any Third Party reports relating to your permitted use of the reports and the corresponding provisions in the terms of the Agreement, the provisions of the reports will prevail.

Our Obligations:

We reserve the right to reject an order and if not rejected we may refuse to provide the services at any time without giving any reason in which circumstances a proportional refund of any payment would be made. Each order, if not rejected by us, will constitute a separate and severable Agreement.

We will use our reasonable endeavours to ensure that the information contained within any report is accurate at the date of its publication. You accept, however, that information on which report is based may be subject to change from the date of its publication and we cannot be held liable for failing to include or omit and information in the report which becomes available after the date of publication.

Any indication what we may give as to the time which we will deliver the reports will be a good faith estimate only. We will use all reasonable endeavours to deliver the reports within the time scale that we have estimated.

Subject to anything else contained within the terms of this Agreement, all other warranties, conditions, terms undertaking and obligations, whether express or implied are expressly excluded.

We will begin compiling the HIP/EPC for the property for you in accordance with your immediately upon placement of your order and payment.

A HIP for a registered freehold property will be produced within 7-14 working days, although this is not guaranteed and other types of properties such as leasehold properties will usually take longer to produce.

These terms and conditions and any contracts entered into through this site are English law.
